Many DUI cases begin with a traffic stop. The State must be able to justify why law enforcement stopped the vehicle. That may involve an alleged traffic infraction, driving pattern, crash investigation, equipment issue, or other claimed basis for the stop. If the stop is not legally supported, evidence gathered afterward may be subject to challenge.
Field sobriety exercises are not the whole case.
Field sobriety exercises are often presented as evidence of impairment, but they must be viewed carefully. Conditions matter: footwear, surface, lighting, medical issues, nerves, instructions, weather, and officer interpretation can all affect performance. Video evidence often becomes critical.
Breath testing and refusal issues require careful review.
If a breath test was taken, the defense should review the machine records, observation period, operator compliance, maintenance records, and whether the result is consistent with the rest of the evidence. If the person refused testing, the defense should review implied-consent warnings and the circumstances surrounding the alleged refusal.
